The Legality Of Recording Phone Calls

Weve briefly mentioned it, but now its time to directly address the issue of how to legally record phone calls. While call recording is legal and useful in a variety of business circumstances, theres one catch: Its considered best practice to inform the people on the other end of the line that theyre being recorded.

One-party consent is the bare minimum, where at least one of the parties consents to the recording. In Canada and some U.S. states, explicit two-party consent is required, but its standard protocol to adopt two-party consent even where its not legally mandated. Plus, its better to be safe than sorry when dealing with phone call recording consent. You dont want to end up with a lawsuit on your hands. If you plan to frequently record your business calls, you may consider hiring an attorney to help you navigate the legality of call recording.

Think about when you call a customer service line and are informed the call may be recorded for quality-assurance purposes. Its only right to obtain the other persons consent before recording the conversation on the line. By letting the other party know youre recording, youll also stay on the right side of the law and show politeness by allowing them to opt out.

Can Interview Be Recorded

The federal law 18 U.S. Code § 2511, which primarily revolves around wiretapping, requires the consent of only one person in the conversation for a recording to be legal. If you are conducting an interview, because you are involved in the conversation, your consent is enough to make an audio recording legal.

Part of the phone interview process now includes describing how the iPhone can help the newsmaker get his or her point across in superior sounding audio and then cajoling, reassuring and instructing the skeptical newsmaker or public relations pro how its done.

Heres how it works: The iPhone, iPad, or iPod Touch essentially replaces a tape recorder.

I tell people to call my cell phone from a landline or other cell phone, with their Apple device handy.

While newsmakers hear and answer my questions on the phone, they simultaneously record their answers on the iOS device.

When the interview is done, they email or otherwise share the raw interview, which I edit for air and online posting.

I instruct them to hold the device about a foot from their mouth.

On an iPhone, the microphone is located directly to the left of the charging port on the bottom of the phone.

On an iPad and iPad Mini, the microphone is a small hole along the top edge of the device.

On the iPod Touch, the built-in microphone is located on the back of the device, near the top, between the iSight camera and LED flash.

    Connecting The Shure Sm

    TapeACall Lite

The Shure SM-58 is a durable microphone commonly used for stage performances and music recordings because of its incredible audio quality and directional recording pattern. You need to be fairly close to and right in front of the microphone, but its directional recording pattern means room noise and other distractions are often excluded from the recording. Thats great if you dont have a dedicated studio space with sound treatment, but still want a high quality audio recording. The Shure SM-58 is also a great microphone for podcast recording in the home. Popular USB and condenser microphones marketed to beginning podcasters are great for semi-studio environments, but in most cases they pick up way too much room noise and audio reflections. The Shure SM-58 solves those problems. Theres also a lower cost version called the Shure SM-48.

Connecting a Shure SM-58 cardioid microphone to an iPhone.

To connect the Shure SM-58 cardioid microphone to an iPhone, well use this series of adapters: Shure XLR to 3.5mm TRS adapter > Rode SC4 3.5mm TRS microphone to TRRS adapter > the standard Lightning headphone adapter that comes with the iPhone. If recording on an iPad, you can skip this last step and plug the Rode SC4 TRRS adapter directly into the headphone jack.

NOTE ON AUDIO EXAMPLES: All audio recording examples in this guide have had audio levels normalized using Audacity so volume levels will be equal across the recordings. No other changes have been made.

An audio recording of an interview also allows you to refer back to the interview and take a fresh look at the interview data, these are some of the advantages of recording interviews in qualitative research.

While recording an interview can be as easy as placing your iPhone on the table and tapping record, though we recommend getting a voice recorder , researchers tend to underestimate the challenges of getting an interview recording with good audio quality.

This, coupled with the fact that the descriptive validity of qualitative data is directly related to the quality of the recording, means that researcher need to pay closer attention to how they record their research interviews.

Why is audio quality so important?

With interview transcription, the accuracy of the transcribed transcript is dependent on the quality of the recording. Poorly recorded interviews tend to have more errors and are usually incomplete due to in-audibles.

Furthermore, most transcribers charge a 50% mark-up fee for poorly recorded research interviews as they take 50% longer to transcribe. A crisp-clear recording of an academic interview makes transcription of the interview easier and faster.
